Data Collected by Users of the Services
In cases where the user includes files containing personal data on shared hosting servers, ONDyTEC 2018 SL shall not be held responsible for the user’s non-compliance with the GDPR.
Data Retention in Compliance with the LSSI
ONDyTEC 2018 SL informs that, as a data hosting service provider and in accordance with the provisions of Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI-CE), it retains for a maximum period of 12 months the essential information required to identify the origin of the hosted data and the time at which the provision of the service began.
The retention of this data does not affect the confidentiality of communications and may only be used within the framework of a criminal investigation or for the safeguarding of public security, being made available to judges, courts, or the relevant authority upon request.
The communication of data to State Security Forces and Bodies will be carried out in accordance with the provisions of the applicable personal data protection regulations.
Intellectual Property Rights – ondytec.com
ONDyTEC 2018 SL holds all copyrights, intellectual and industrial property rights, know-how, and any other rights related to the contents of the website and the services offered therein, as well as the software necessary for its implementation and the related information.
The reproduction, publication, and/or use of the contents, in whole or in part, of the website, other than for strictly private use, is not permitted without prior written consent.
Software Intellectual Property
The user must respect third-party software made available by ONDyTEC 2018 SL, even when it is free of charge and/or publicly available. ONDyTEC 2018 SL holds the necessary exploitation and intellectual property rights over such software.
The user does not acquire any right or license, by virtue of the contracted service, over the software required for the provision of the service, nor over the technical information related to service monitoring, except for the rights and licenses strictly necessary for the fulfillment of the contracted services and only for the duration of such services.
For any action exceeding the performance of the contract, the user shall require prior written authorization from ONDyTEC 2018 SL. The user is expressly prohibited from accessing, modifying, or viewing the configuration, structure, and files of the servers owned by ONDyTEC 2018 SL, assuming civil and criminal liability for any incident that may occur in the servers and security systems as a direct consequence of negligent or malicious actions on their part.
Intellectual Property of Hosted Content
The use of the services provided by ONDyTEC 2018 SL in violation of intellectual property legislation is prohibited, and in particular:
- Any use that is contrary to Spanish law or infringes the rights of third parties.
- The publication or transmission of any content that, in the opinion of ONDyTEC 2018 SL, is violent, obscene, abusive, illegal, racist, xenophobic, or defamatory.
- The use of cracks, software serial numbers, or any other content that infringes third-party intellectual property rights.
- The collection and/or use of personal data of other users without their express consent or in violation of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR).
- The use of the domain’s mail server and email addresses for sending unsolicited bulk communications (spam).
The user assumes full responsibility for the content of their website, the information transmitted and stored, hyperlinks, third-party claims, and legal actions related to intellectual property, third-party rights, and the protection of minors.
The user is responsible for compliance with applicable laws and regulations, as well as rules relating to the operation of online services, electronic commerce, copyright, public order, and generally accepted principles of Internet use.
The user shall indemnify ONDyTEC 2018 SL for any expenses arising from claims or legal actions in which ONDyTEC 2018 SL may be involved due to causes attributable to the user, including legal defense fees and costs, even in the event of a non-final judicial decision.
Protection of Hosted Information
ONDyTEC 2018 SL performs backup copies of the content hosted on its servers; however, it shall not be held responsible for the loss or accidental deletion of data by users. Likewise, it does not guarantee the full restoration of data deleted by users, as such data may have been removed and/or modified during the time elapsed since the last backup.
The services offered, except for specific backup services, do not include the restoration of content stored in the backup copies made by ONDyTEC 2018 SL when such loss is attributable to the user. In such cases, a fee will be determined according to the complexity and volume of the recovery, subject to prior acceptance by the user.
Data restoration is only included in the service price when the loss of content is attributable to ONDyTEC 2018 SL.
Commercial Communications
In accordance with the LSSI-CE, ONDyTEC 2018 SL will not send advertising or promotional communications by email or any other equivalent electronic communication means unless they have been previously requested or expressly authorized by the recipients.
In the case of users with whom there is a prior contractual relationship, ONDyTEC 2018 SL is authorized to send commercial communications related to products or services of ONDyTEC 2018 SL that are similar to those initially contracted by the client.
